These Terms of Service (“Terms”) govern your access to and use of the online file-processing services operated by Blue Pea Agro Tech, an entity incorporated and operating in India (“Company”, “we”, “us”, or “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
We provide online tools that allow users to upload files and request processing operations such as file conversion, compression, optimization, or other functionality made available through our website.
The specific tools, limits, features, processing times and availability may change from time to time.
The Services are operated from India and are initially offered to users in India and in other jurisdictions that we expressly make the Services available to.
The Services are not offered or directed to users located in the European Union or European Economic Area.
We may restrict access from particular countries or territories at our discretion.
If you are located in a jurisdiction in which the Services are not offered, you must not use the Services.
We may use technical measures, including IP-based or other geographic controls, to restrict access where appropriate.
This section does not purport to exclude any mandatory legal rights that cannot lawfully be excluded.
The free version of the Services may be used without creating an account, subject to the limits displayed on the website.

The operation limit does not guarantee unlimited computing resources. We may apply reasonable technical limits relating to file size, number of pages, processing time, CPU usage, memory usage, total processing volume, or other resource consumption.
Paid Services are priced in United States dollars (USD) or Indian Rupees (INR) as displayed at checkout. Applicable taxes and payment conversion charges apply.
Where a paid plan is offered as a subscription, the subscription will renew according to the billing interval presented at purchase unless cancelled in accordance with the applicable cancellation procedure.
Payments are processed by third-party payment providers.
We do not intend to store full payment-card numbers or other sensitive card authentication data on our own systems.
Payment-provider terms may also apply to your transaction.
Refund eligibility, cancellation procedures and any applicable refund periods are described in our applicable billing/refund terms presented during purchase or incorporated into these Terms.
Cancellation of a subscription does not necessarily result in an immediate deletion of an account or files that are still within the applicable retention period.
You retain your rights in files you upload.
By uploading a file, you confirm that:
You authorize us to access, process, temporarily store and transmit the uploaded file solely as reasonably necessary to provide the requested Service, maintain security, prevent abuse, comply with law, and operate the Service.
You must not use the Services:
The Services are general-purpose file-processing tools.
Unless we expressly state otherwise, the Services are not designed to provide specialized handling guarantees for highly sensitive, regulated, classified, medical, financial, governmental, or similarly high-risk information.
Users remain responsible for determining whether the Services are appropriate for the files they intend to process.
Files are retained only for the periods described in our Privacy Policy and applicable Service description.
Free-service processed files are ordinarily retained for up to 60 minutes.
Paid-service processed files may be retained for up to 7 days.
Users may delete files earlier where the Service provides a deletion function.
Original uploaded files may be deleted as soon as they are no longer required for processing, subject to technical requirements, security requirements, legal obligations and applicable backup lifecycles.
Deletion from active systems does not necessarily mean that every copy in a backup system disappears immediately. Backup copies are subject to the Company's applicable backup lifecycle.
We will make reasonable efforts to keep the Services available, but we do not guarantee uninterrupted or error-free operation.
The Services may be unavailable because of maintenance, hardware failure, network problems, security incidents, third-party services, force majeure events or other circumstances.
We use reasonable technical and organizational measures designed to protect files and account information.
These measures may include encrypted connections, encrypted storage, access controls, isolated processing environments, rate limiting, resource restrictions and automatic deletion.
Because files must generally be processed on our servers to provide server-side processing services, we do not describe the Service as providing strict end-to-end encryption unless a particular feature expressly provides it.
No internet service can guarantee absolute security.
Paid users are responsible for maintaining the confidentiality of their account credentials and for activity occurring through their account.
You must provide accurate information and must not impersonate another person.
We may suspend or terminate an account where reasonably necessary to protect the Service, users, or our legal rights.
The Services, website, software, design, trademarks, branding and other Company materials remain the property of the Company or its licensors.
Except for the rights expressly granted under these Terms, no ownership rights are transferred to you.
If you voluntarily provide suggestions, ideas or feedback regarding the Services, you grant us permission to use that feedback to improve the Services without compensation to you.
The Services may depend on third-party providers, including hosting, infrastructure, security, authentication, analytics and payment providers.
Your use of those services may be subject to their own terms and policies.
We may suspend, restrict or terminate access where reasonably necessary because of:

We do not guarantee that processing will always produce a particular result or that files will never be corrupted, lost, delayed or unavailable.
Users should maintain their own copies of important original files.
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data arising from the use of the Services.
Cap on Liability: The Company's aggregate monetary liability arising out of or related to the Services for any user, regardless of jurisdiction or cross-border location, shall be strictly limited to:
To the extent permitted by applicable law, you agree to indemnify the Company against claims, losses and reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or your unauthorized upload or processing of another person's files.

The Privacy Policy is a privacy notice describing how we process personal information and does not replace these Terms as the contractual terms governing use of the Services.
We may update these Terms from time to time.
Material changes will be communicated through the website or other reasonable means where appropriate.
Your continued use of the Services after the effective date of an updated version constitutes acceptance of the updated Terms to the extent permitted by applicable law.
These Terms are governed by and construed in accordance with the laws of India. You irrevocably agree that the courts located in Kannur, Kerala, India shall have exclusive jurisdiction to settle any dispute or claim arising under these Terms.
